Common Questions

Can I Have an Affidavit Notarized Without the Person Who Signs It Being There?

No. The person who signs must appear before the notary in person at the time of notarization. The 2004 Rules on Notarial Practice (Rule IV Sec. 2(b)) bar a notary from notarizing for someone who is not personally present. A notary who does it can lose their license to notarize (their commission).

Can I Sign the Affidavit at Home and Bring It to the Notary?

Better not. An affidavit is notarized by jurat (you swear to it before the notary), and under Rule II Sec. 6 of the 2004 Rules on Notarial Practice you must sign it in front of the notary. Bring it unsigned, with every blank filled in. A notary will not notarize a blank or incomplete document (Rule IV Sec. 6).

What IDs Does a Notary Accept?

At least one current ID issued by a government agency that shows your photo and signature, such as a passport, Driver's License, PRC ID, UMID or PhilSys ID (Rule II Sec. 12 of the 2004 Rules on Notarial Practice, as amended in 2008). A cedula alone is not enough because it has no photo. If you have no ID, the rules allow identification by one or two credible witnesses who know you.

Can a Notary Notarize an Affidavit for a Relative?

No. Under Rule IV Sec. 3(c) of the 2004 Rules on Notarial Practice, a notary may not notarize for their spouse, common-law partner, ancestor, descendant, or a relative by blood or marriage within the fourth civil degree (up to first cousins). They also may not notarize a document they are a party to or benefit from.

What Happens If Something in My Affidavit Is False?

Knowingly lying under oath about something important is perjury under the Revised Penal Code (Art. 183). Read the affidavit carefully before you sign, and only state what you know to be true.
