Before You Print
- Not legal advice. This is a general form. For your own situation, consult a lawyer, especially if your case is unusual or a lot of money is involved.
- You will swear before the notary that it is true, then sign (this is called a jurat).
- Do not sign it yet. You sign in front of the notary, with a valid government ID.
- Under Article 14 of the Family Code, the consent can be given by the parent appearing in person before the Local Civil Registrar, or by an affidavit signed in front of two witnesses and sworn before a notary or another official who can give oaths. This form is the affidavit. The two witnesses sign too.
- The consent comes from the father, the mother, the surviving parent or the guardian, in that order. Ask the Local Civil Registrar whether it wants one parent or both.
- If you are 21 to 25, the law asks instead for your parents' advice (Family Code, Article 15). That is a different document.
