NOTARY PUBLIC

Before You Print

  • Not legal advice. This is a general form. For your own situation, consult a lawyer, especially if your case is unusual or a lot of money is involved.
  • You will swear before the notary that it is true, then sign (this is called a jurat).
  • Do not sign it yet. You sign in front of the notary, with a valid government ID.
  • Under Section 109 of the Property Registration Decree, Presidential Decree No. 1529 (PD 1529), the owner must report the loss under oath to the Registry of Deeds where the land is, as soon as they find out it is lost. File this affidavit there and ask them to write a note of the loss on the title (an annotation).
  • A new owner's copy is issued only if the Regional Trial Court orders it. Someone must file a request in court (a petition), and the court gives notice and holds a hearing first. You will usually need a lawyer to file the petition. If you cannot afford one, the Public Attorney's Office helps people who qualify. See the full steps for a lost title.
  • Get a Certified True Copy of the title from the Registry of Deeds first, and copy the title number, the lot description and the registered owner exactly as they appear on it.
  • If the title was stolen, or you think someone may use it, report it to the police too, and keep a copy of the report for the Registry and the court.
