- Not legal advice. This is a general form. For your own situation, consult a lawyer, especially if your case is unusual or a lot of money is involved.
- You will swear before the notary that it is true, then sign (this is called a jurat).
- Do not sign it yet. You sign in front of the notary, with a valid government ID.
- This affidavit only states the facts of your care. It does not make you the child's legal guardian. To become the child's legal guardian, with the power to decide for the child or to manage the child's property, you need a court order or another legal process. For that, see a lawyer, or the Public Attorney's Office if you qualify.
- Offices set their own rules. The PSA, for example, accepts an Affidavit of Guardianship from a grandparent, an older sibling aged 21 or over, or another adult aged 21 or over who actually cares for the child, backed by a Barangay Certification or a school record naming you as guardian.
