  • Not legal advice. This is a general form. For your own situation, consult a lawyer, especially if your case is unusual or a lot of money is involved.
  • It does not need a notary to be valid. Sign it, and keep a signed copy.
  • Under Article 300 (formerly Article 285) of the Labor Code, an employee who resigns without a valid legal reason (a just cause) must give the employer written notice at least one month in advance. Pick a last working day at least 30 days after the day your employer receives the letter, unless your employer agrees in writing to a shorter period.
  • You may resign without notice for the just causes in the same article: serious insult by the employer or their representative, inhuman and unbearable treatment, a crime against you or your immediate family by the employer or their representative, and similar causes. This simple letter does not cover that situation.
  • It does not need to be notarized. Make two copies and ask your employer to sign and date the receiving copy, or send it by email and keep the reply.
  • Your employer should release your final pay within 30 days from your last day and your Certificate of Employment within 3 days of your request, under DOLE Labor Advisory No. 06, Series of 2020, unless a company policy or agreement gives you more.
