- Not legal advice. This is a general form. For your own situation, consult a lawyer, especially if your case is unusual or a lot of money is involved.
- It does not need a notary to be valid. Sign it, and keep a signed copy.
- Under SEC Memorandum Circular No. 18, Series of 2019, the Securities and Exchange Commission (SEC) bans lending and financing companies, and their collectors, from collecting debts unfairly. This includes threats, insults and swearing, sharing a borrower's name or personal information to shame them, lies or tricks, and contacting the borrower at unreasonable hours.
- Disputing the amount does not erase what you really owe. Say what you are willing to pay, and keep paying any part you do not dispute if you can.
- Keep screenshots of every message, call log and post, with dates and the numbers or accounts used. You can report harassment to the SEC, and misuse of your contacts or personal data to the National Privacy Commission. See the guide Debt collection harassment.
- Send it through the company's official email or address, as shown on the SEC's list of registered lending and financing companies or in the app, and keep proof of sending.
- If you are threatened with violence, report it to the police or the PNP Anti-Cybercrime Group as well.
