Before You Print

  • Not legal advice. This is a general form. For your own situation, consult a lawyer, especially if your case is unusual or a lot of money is involved.
  • You will sign it before the notary and confirm you signed it freely (this is called an acknowledgment).
  • Do not sign it yet. You sign in front of the notary, with a valid government ID.
  • Signing this is not enough on its own. Give a copy to the person you authorized (your attorney-in-fact), and ask for the original SPA back (Civil Code, Article 1920). Also tell the people, banks or offices they dealt with or were meant to deal with. A revocation does not bind other people who acted in good faith without knowing about it (Civil Code, Articles 1921 and 1922).
  • Send the notices in a way you can prove later, such as personal delivery with a signed receiving copy, or registered mail or courier with proof of delivery.
  • If the SPA was recorded with the Registry of Deeds or noted on a title, ask the Registry about recording the revocation too.
  • Some powers cannot be cancelled whenever you like, for example when the authority is part of a contract with another party or is in their interest (Civil Code, Article 1927). If that may be your case, talk to a lawyer.
