Common Questions
Does a Deed of Sale Need to Be Notarized?
The Civil Code (Art. 1358) requires a public document, such as a notarized deed, to create or transfer rights over land and buildings. An unnotarized sale can still bind the buyer and seller, but the Registry of Deeds will only register a deed that the signers confirmed before a notary (acknowledged) (Presidential Decree No. 1529, Sec. 112), and without registration the title cannot be transferred.
Is a Notarized Deed of Sale Enough to Own the Land?
Between buyer and seller, a notarized deed generally counts as handing over the property. Against everyone else, registration with the Registry of Deeds is what counts (PD 1529, Sec. 51). After notarization, pay the taxes, get the BIR's eCAR and register the transfer. See transferring a land title.
The Seller Is Abroad. Can the Sale Still Go Ahead?
Yes, either by the seller signing the deed abroad before a Philippine consul or a local notary (with an apostille), or by giving someone a Special Power of Attorney to sell. Selling land on someone's behalf needs an SPA (Civil Code, Art. 1878). See the SPA to sell property template.
Is the Notary's Fee the Only Cost of a Sale?
No. The sale also carries capital gains tax, documentary stamp tax, the local transfer tax and registration fees, which are separate from the notary's fee. See what a Deed of Sale costs and the property sale costs calculator.
