NOTARY PUBLIC

Before You Print

  • Not legal advice. This is a general form. For your own situation, consult a lawyer, especially if your case is unusual or a lot of money is involved.
  • You will sign it before the notary and confirm you signed it freely (this is called an acknowledgment).
  • Do not sign it yet. You sign in front of the notary, with a valid government ID.
  • The Civil Code says a donation of land must be in a public document, such as a notarized deed, and the person receiving it (the donee) must accept it while the giver (the donor) is alive. That is why the donee accepts in this same notarized deed.
  • Donor's tax is paid to the BIR before the title can be transferred. See the guide Donating property and the donor's tax calculator.
  • A donation cannot take away the shares the law sets aside for the donor's heirs who cannot be left out, such as a spouse and children (compulsory heirs). If the land is most of what the donor owns, have a lawyer look at it first.
