Special Power of Attorney (SPA) or Other Everyday Document

A Special Power of Attorney (SPA) lets someone act for you, such as selling, renting out or claiming something in your name. It and most other everyday documents are notarized by you confirming before the notary that you signed it (this is called an acknowledgment).

Common Questions

What Is the Difference Between a Special and a General Power of Attorney?

A General Power of Attorney covers only day-to-day management (acts of administration), such as looking after property (Civil Code, Art. 1877). To sell or mortgage property, borrow money, or do the other acts listed in Art. 1878, you need a Special Power of Attorney that names the act. See the SPA guide.

How Long Is an SPA Valid?

The Civil Code sets no fixed expiry. The authority ends when its purpose is done or its period runs out, when the person who gave it cancels it, or when either the person who gave it or the person authorized dies, among other causes (Art. 1919). Banks and government offices may have their own rules on how recent an SPA must be, so ask the office before you go.

Does the Person I Am Authorizing (the Attorney-in-Fact) Need to Appear Before the Notary?

No. Only the person giving the authority (the principal), who signs it, must appear in person (2004 Rules on Notarial Practice, Rule IV Sec. 2(b)). The attorney-in-fact does not sign the SPA unless the document asks them to accept.

I Am Abroad. How Do I Give Someone in the Philippines an SPA?

Sign it before a Philippine embassy or consulate, or before a local notary in your country and then get an apostille there, if that country is part of the Apostille Convention. See consularization vs apostille.

My Parent Is Bedridden. Can They Still Sign an SPA?

Yes. A notary may go to a hospital or similar place where a person is confined (2004 Rules on Notarial Practice, Rule IV Sec. 2(a)). A person who cannot sign may use a thumbmark in front of the notary and two witnesses who have no stake in the document (disinterested witnesses) (Rule IV Sec. 1(b)). The person must still understand what they are signing.
