Common Questions

Does a Lease Contract Need to Be Notarized?

Not to be valid. A lease longer than one year must be in writing to be enforceable (Civil Code, Art. 1403(2)(e)). Notarizing it makes it a public document, and a lease must be registered with the Registry of Deeds to bind other people, such as a later buyer (Art. 1648). See the Contract of Lease template.

What Happens to My Lease If the Owner Sells the Property?

Under the Civil Code, the buyer may end the lease unless the Contract of Sale says otherwise or the buyer knew of the lease (Art. 1676). A lease of land or a building binds other people only once it is recorded with the Registry of Deeds (Art. 1648), so registering a long lease protects the tenant.

How Long Can a Lease Run?

A lease of things cannot be for more than 99 years (Civil Code, Art. 1643). Within that limit, the two sides choose how long it runs.

Do Both the Owner and the Tenant Have to Appear Before the Notary?

Yes, everyone who signs must appear in person with an acceptable ID (2004 Rules on Notarial Practice, Rule IV Sec. 2(b)). A party who cannot come can authorize someone by a Special Power of Attorney. See renting out property.
