Common Questions

Does a Deed of Sale for a Car Need to Be Notarized?

A sale of a car is valid between buyer and seller even without notarization (Civil Code, Art. 1356), but the LTO asks for a notarized Deed of Sale to transfer the registration. See transferring car ownership and the template.

What Is an Open Deed of Sale, and Is It Safe?

An open deed is one the seller signs with the buyer's name left blank. It is risky for the seller: until the transfer is recorded with the LTO, the seller stays the registered owner, and the Supreme Court has held registered owners liable to third parties for accidents involving their vehicle. A notary should also not notarize a document with blanks (2004 Rules on Notarial Practice, Rule IV Sec. 6).

Do Both the Buyer and the Seller Need to Appear Before the Notary?

Everyone who signs the deed must appear in person and show a valid ID (competent evidence of identity) (2004 Rules on Notarial Practice, Rule IV Sec. 2(b)). If one of them cannot come, they can sign a Special Power of Attorney for someone to sign for them.

Can I Sell a Car That Is Still Being Paid to a Bank?

A car bought on a loan usually has a mortgage in the bank's favor (a Chattel Mortgage). The mortgage has to be paid and released before the LTO will transfer the car free of it, so talk to the bank first.
